    NOTICE OF UNLICENSED OPERATION

    Case Number: EB-FIELDNER-22-00033739

    On June 21, 2022, in response to complaints, an Agent from the Chicago Office of the Federal Communications Commission’s (FCC or Commission’s) Enforcement Bureau (Bureau) confirmed by direction finding techniques that continuous one-way radio transmissions on the Citizens Band Radio Service (CBRS) frequency 27.395 MHz were emanating from your residence on Rio Vista Court in Rockford, Illinois. These transmissions occurred for over 30 minutes and prevented other operators from using the frequency.

    Section 95.333(d) of the FCC rules 47 CFR § 95.333(d).
    prohibits persons from using a Personal Radio Service station to intentionally interfere with the communications of another user. Section 95.933 of the FCC rules 47 CFR § 95.933(a), (f), (g).
    prohibits an operator of a CBRS station from transmitting one-way communications, music, whistling, sound effects, and other audio material to amuse or entertain, and from transmitting sound effects to solely attract attention. Section 95.357 of the FCC rules 47 CFR § 95.357.
    requires that the operator of a Personal Radio Services station must generally limit transmissions to the minimum duration necessary. Section 95.359 of the FCC rules 47 CFR § 95.359.
    specifies that all channels designated for use in the Personal Radio Services are available for use on a shared basis, are not assigned by the FCC for the exclusive use of any person or station, and that operators of Personal Radio Service stations must cooperate in the selection and use of channels in order to avoid interference and make efficient use of these shared channels.

    You are hereby warned that violation of the rules cited above voids your authorization to operate radio transmitting equipment 47 CFR § 95.905.
    and constitutes a violation of the 47 U.S.C. § 301 and could subject you to severe penalties, including, but not limited to, substantial monetary fines, in rem arrest action against the offending radio equipment, and criminal sanctions including imprisonment. See 47 U.S.C. §§ 401, 501, 503 and 510.


    UNLICENSED OPERATION OF THIS RADIO STATION MUST BE DISCONTINUED IMMEDIATELY.

    You have ten (10) days from the date of this notice to respond with any evidence that you have authority to operate granted by the FCC. Your response should be sent to the address in the letterhead and reference the listed case number. Under the Privacy Act of 1974, 5 U.S.C. § 552a(e)(3).
    we are informing you that the Commission’s staff will use all relevant material information before it to determine what, if any, enforcement action is required to ensure your compliance with FCC Rules. This will include any information that you disclose in your reply.

    Probably not, But now they’re on the FCC’s radar, and the last thing you want to be, not outta sight, your not out of mind! You’re on the list, do you want to be on the list, didn’t think so.
