You can listen all you want ... transmit is totally illegal.

    CUA: GMRS/FRS NO.

CAP: IF ... and IF it is on the list of approved radios.

MARS: Possibly. If the radio does not qualifty for CAP, then when MARS does go with NTIA specs, it will NOT qualify for MARS.

You will also require specific CAP authorization, for specific frequencies; MARS requires an MARS license, and with that, the MARS Net Control can furnish you with the mod info. Also, most reputable manufacturers (YaeComWood) will provide you with the mod info if you spuuly tthem with copies of your Amateur AND MARS license, but not before.
ANY other use would be illegal, for whatever reason or rationalization. (And if you claim for potential "emergency use," somebody had better be dead or dying before you use THAT excuse...) And be able to prove NO OTHER means of communication was available or in service.)

Go to the Yahoo group for VX-7R. You will find all sorts of mods posted and discussed. You will not have to read pontifications about what is legal and what is not.

IE, part of helping people understand the why's and why not's, include pointing those items out.

If this causes you a problem, then so be it. It is YOUR license, not mine.

Glen, K9STH has posted more than once about several FD's who got nailed big time using ham gear instead of the then Type Accepted (now called Certified) gear.

CAP use calls for high stability units. MARS is going that way, thanks to the NTIA. Not all radios will be able to meet the CAP requirements.
