    As I wrote (the last time you asked), I have a Hexbeam on a push-up mast attached to the rear wall of the house easily seen on google map. I’m not often home which limits my activity there but I made 2qsos on 10/30/25 with Kosovo and San Andres on 10M CW.
    Do you want to depose me to satisfy your hate that my HOA disproves the myth about HOAs to which you cling?

    Apparently, there's a difference between "antenna restriction" and "antenna bans"

    In one of these situations HOA's permit antennas, and in the other situation HOA's do not permit any antennas.

    It's important not to blur these lines of unique distinction...

    Now please define what you mean when you say, "Antenna restricted HOA living."
    This would seem to imply the HOA does allow and permit antennas in the HOA rules. Is this what you are talking about?

    They are actually quite “blurry”. While my HOA CC&Rs clearly ban antennas, the rules adopted years ago by the Board specifically allow modification and prescribe conditions to approve them (which they have done).

    A stop sign is a stop sign... It only has one meaning... Or at least it should.
    In this instance, HOA rules are unclear, subjective, ambiguous, and even contradictory in scope and practice. This is where the proposed antenna legislation defines the rules and expectations in a clearer light for all the HOA residents, and even the HOA itself for that matter.

    IIRC, your antenna(s) are NOT HOA approved.

    As I understand it, you just put it/them up in defiance of the HOA rules, but no one has made an issue of it.

    Please correct me if I'm wrong.

    Generalities are always wrong sometimes. But I like the confidence, albeit misplaced, with which you present yourself as an expert on the matter.

    As VSK said above, to me they also are "blurry". But.....

    My best explanation for a "restriction" scenario would be a CC&R that has language something like..."Amateur radio antennas are prohibited, unless approved by the Architectural/Design Review Committee". That kinda might give you hope that something could be worked out with the HOA.

    On the other hand, language like..."Amateur radio antennas are prohibited"...period...would be interpreted as a "ban".

    The CC&R in my community has the "unless approved" designation. But 23 years ago I decided to circumvent the approval process, which would give them the yay or nay to my ham radio operation. And would alert them that I am a ham, giving them a heads up to check/see if I violate or exceed their "yay" limited visibility approval, or their "nay" turn-down on any antenna.

    Everyone can make their own decision within their HOA situation. For me...so far, so good;).

    I don’t understand the reason for putting the interference clause in the instrument. The drafters sometimes styled the redactors, have the tendency to overdo it and create unforeseen consequences. Interference and RFI are the province of the federal government under the 10th amendment.

    Some people overthink this clause and actually put more into it than what is needed. Once a local court sees the RFI/interference clause, it is a clear sign that it is outside the bounds of Court Vires, that is the powers of the court, Do not allow it to hear inference cases. Failure by over drafting.

    You read correctly...exactly what I said. My (stealth) antenna(s) are NOT HOA approved;). And I never asked for their approval. I've stated as such many, many times in the past on various threads/posts. As such, I am a criminal defier of *one* CC&R rule in my community:cool:. No one has made an issue of it.

    I comply with every other one, as to us they're no big deal and have no influence on our quality of life. In 23 years, I've been tagged with one CC&R violation...two desert plants in my front yard landscaping were dead. I promptly replaced them. All good...end of story:).

    I think it's wonderful. :)

    It means I can just call up my HOA enforcement people at any time if any interference is occuring to my SW radio reception from my neighbors "electronic devices."

    Now imagine living in a world where your stealth antennas are HOA approved and even encouraged for that matter by your HOA.

    You know, you don't have to hide in the shadows and live like an illegal radio refugee...

    There is a better way and it just needs your support.
