This is an interesting topic: On one hand the repeater operator can say stay off my repeater or you'll be ticketed, while you can realistically say the repeater operator doesn't own the frequency, only the equipment on the frequency. A judge could tell him to put some form of tone squelch on his receiver so you could use the frequency while not his equipment, he could tell you to stay off the frequency altogether, or he could strongly suggest you all learn how to get along.
I dunno. I guess I believe we are supposed to behave in a civilized manner to each other and fellow members of the community. In the immortal words of the great 1990's statesman Rodney King, why can't we all just get along?
