    Here we go again the "think tank" people can't seem to wrap their minds around the difference between a REAL disaster and thier PLAY DATE (ie. drill excercise) disaster. This inability to differentiate the 2 makes it impossible for them to see REAL disaster equals no violation when employees for the FD using ham radio due to all other comms down (another concept they can't comprehend) versus their PLAY DATE activity which IS a violation if the FD employee uses the radio in a fake emergecy. And the phone call that started this thread didn't seem to change this fact. All that was confirmed is no citation would be written for ham radios being used in the PLAY DATE already spelled out in writing in the rules and clarified by Cross and Smit. If the ecommers that work for agencies want to roll the dice and play on the radio during these excercises good luck. Someone in the area should record the activity and submit calls of known employees and send it to the FCC and see what if anything happens. That would but this debate to end once and for all. Short of a test case this debate will never end.

    Because they want to harshly interpret 97.113 a 2
    lets harshly interpret 97.113 a 5

    because after all, we all could use another radio service for communications.

    But we choose to use amateur radio to continue advancing a radio service we all enjoy.

    Very good observation, if the narrow minded anti-emcom crowd keep crying to the FCC for enforcement of rules, they might get their wish granted!

    We all could easily be in violation for ragchewing on 2m repeaters, after all, your cellphone with free/unlimited minutes or Nextel is right there readily available on a regular basis for such calls.

    Your Iphone with Skype, your Vonage and your Internet browser would negate the need to have regular conversations on 20, 40 or 80 on a regular basis.

    What some of you fail to see with your "cry to the FCC" for everything is just going to justify more narrow enforcement of all the rules. 97.113 A 5 pretty much makes 90 percent of everything done on a "regular basis" that could be "furnished alternatively" through other radio services including ragchewing, unlawful.

    Do you really want the FCC to go through and start splitting hairs? Keep giving them fuel to fire the end of our service, and more justification for FCC Spectrum Sales and Rentals, Inc. to take it away.

    If one has a legitimate concern about someone using ham radio in place of a business radio, fine- turn them in. If I ever hear someone dispatching a taxi or ambulance over ham radio, with rare exception citing a complete catastrophic event, you'd bet I'd be first one with a letter to Dr. Laura.

    But don't waste her and the FCC's time with nitpicking. You don't want them to come in and clean house, it isn't good for any of us. Including you N3XP, from 97.113 A 5:

    "I spend my free time: Chasing DX, ragchewing,[/B]"

    So all that time you say your spend with the guys on simplex would appear you may be in violation of 97.113 A 5, as I am sure your communications could easily take place on another service could it not? I am sure all you all have cellphones (part 80) or landline, so looks to me like when that "smackdown" you want the FCC to conduct, you may be caught up in the mess yourself along with us "emcomm ninjas" for our alleged violation of part 97.

    Be careful what you ask for, you just might get it.

    It's very simple: you want such a narrow interpretation of the rules, yet when the same standard is applied to you, you have nothing but this to say?

    O.K. Here is the poop.
    I am against Served agency officials, such as Mr. Jordan, WA3GIN (who BTW works in Computer Security, for the Arlington, VA county government getting a "conference call" in regards to "Homeland Security" given by the PR people at the FCC, when Mr. Ed (KE4SKY) works for the Fairfax County Government Public Works, or maybe he is retired now) but do you all see where I am going with this.
    The one ham who is the retired cop who posted early on has hit the nail on the head, the EMCOMM wannabees have tried repeatedly to take over 1) spectrum 2) authority in managing disasters from Public Service, and Mr. Jordan may appreciate the fact that I recently told the Enforcement Dept and T-MARC confirmed this about the little repeater that Arlington RACES is using,on 145.170 (-) PL 107.2 to have on standby-- so that they can use it for drills, which according to the voluntary regulatory body is A) uncoordinated and B) not supposed to be on the frequency it is now.
    Maybe Mr. Jordan can put that in his pipe and smoke it.:eek:
    The Northern VA. area repeaters are all full of EMCOMMERS who 1) work or worked for the Federal or State or City Government and 2) want to control all other ham activities, going so far as to put out a re-written OMB document for the Marine Corp Marathon, telling ham volunteers they cannot sue the US government if they become injured during the Marathon, which is being disseminated by a former CIA employee-ham.
    Do you all get the picture now??
    The government owns EMCOMM in the DC area, and is fighting for the F.C.C. to finally grant its wish- giving background checks to all hams, and to
    get them in trouble, if they resist.
    I am a civilian, never worked for the government , but too many Chiefs, and not enough Indians-- is exactly why such groups as ARES and RACES only attract the real whackers, and resistance is cause for expulsion from them, which is why I am blowing the lid off this topic wide open, you are free to
    ask questions, and can I please hold a news conference, to detail the sad facts. I am standing up for my rights and one of those is right to "petition the government for redress of greivences." Part 90 radios to all EMCOMMERS !
    Get them out of the ham bands, so the rest of us can talk about our medical problems !

    Federal Government agrees to let County government employee paid wackers, to handle EMCOMM radio communications forever ! HAHAHAHAH

    :confused:You enjoy ham radio for what YOU believe it to be. For YOUR enjoyment. Don't belittle how others enjoy ham radio and don't minimize the value of ham radio for emergency situations. Emcomm drills merely 'train' operators in the skill of communications and aren't intended nor used as replacement for ROUTINE telecommunications for or on behalf of other entities. TRAINING, SKILL DEVELOPEMENT. That's what part 97 describes as part of ham radio.
    There's no 'virus' nor 'infection' and no destruction will result. A very small percentage of licensed amateurs participate in these training programs.
    YOUR perception doesn't make rule nor purpose for all!;)

    This is about the most intelligent thing added to this thread so far. But the bottom line is some people cannot just leave others alone, they insist on creating this house divided which, unfortunately, will also fall as hard on them as well as those they have a personal vendetta against.

    Sad, because in the end, we are indeed are own worst enemies.

    You are quite correct! I see it as a kind of "no, not in MY back yard!" and also like a sort of "homeowners commitee" bent on maintaining a limited design imposed on everyone, ie. same color, same architecture, same size to fit all!

    Some clarity

    I work in a hospital and have been involved in setting up ham radio for back-up communications. The hospital that I work for is part of a network of 5 area hospitals and a corporate headquarters site. We will have ham radio set up at each site for emergency communications. The ham radio set-up is kind of like car insurance. You hope you will never have to use it, but it will be there just in case. I do participate in drills as a volunteer and I may be on the clock working when an emergency happens.

    There is no violation of any rules with this set-up and all the screaming from the uninformed will not change that. I am a member of the local ARES group and it takes three parts to make this work.

    1) Valuable spectrum that can be used during an emergency
    2) Ham radio enthusiast who knows how to run the radios/antennas
    3) Some training to know how to interface with those in charge during an emergency.

    I have almost 30 years experience working in a hospital and I realize that the backup radio system will be rarely used. When it is used it will provide situational information by intercept, some additional situational information from other ham radio operators and message traffic between served agencies.

    Why make something that is so basic so difficult to understand.

    Yeah, you may want to brush up on part 97 and the recent FCC actions, oddly involving hospitals.
