so what happens now? All I found in the "order" was that the DOJ wil get involved if he doesn't pay. His license renewal wa sset aside but is his license officially terminated?

My instinct tells me that it ain't over till it's over.

I wouldn't be surprised to see him fight this, refuse to pay, and keep transmitting anyway.

In any event, this all serves to give him the attention that he's been seeking, for better or for worse.

Still, it's nice to see some serious pressure for a change.

You're right, Fred, and here is his "clipped" latest.  (If you don't want it, feel free to axe it.  I'll understand [IMG] )

The "Order" is attached below.   What Now?

    1.  The FCC has declined to provide a requested hearing, and the Fifth
Amendment to the United States Constitution requires a hearing and due
process of law before they can collect a dime much less the "ORDERED"
"fine" of $21,000.   Even a traffic ticket gets a hearing, right?

    2.  Therefore, the next step for the FCC, by statute, is to now sue
K1MAN for the claimed $21,000 in Federal District Court in Bangor,
Maine where K1MAN would demand a trial by jury (trial de novo),
subpoena witnesses (Hollingsworth, Boston Office Engineers, hams,
etc.), file motions, etc.  The FCC can't even bring such a suit, of
course, because the minimum claim in Federal District Court is
    $50,000.

    3.  By statute, unresolved forfeiture matters such as above cannot be
used in any other FCC proceeding such as K1MAN's pending renewal
    application.

    4.  By statute, K1MAN can and will continue to operate until the
renewal application is finally decided including all appeals to the
D.C. Court of Appeals and the U.S. Supreme Court.

Bottom line is that the FCC is blowing phony legal smoke leading to
Hollingsworth's 2006 Dayton "Special Achievement Award" which is not
too bad for a guy who was sick on the day they taught law at law
school.   Wake Forest Law School should refund all of his hard earned
money!   Good luck in the contest!

You may wonder how the ARRL uses your $39, but there is no question as to how K1MAN will be spending all that money you sent him to join the American Amateur Radio Association!

No. Didn't send money to K1MAN, didn't send money to the ARRL. I'd rather see my money go into clubs that will use it than some lobbyist or lawyer's pocket.

Cool. I remember Glenn broadcasting his drivel on 20 meters roughly twenty years ago. This action is long overdue.

Yep, Brian, part and parcel. Take it before A.E. Newman Bush at 1600 Pennsyltucky Avenue.

He might let you have some water from the Potomac. Downstream from his house, of course.

Too little and too late! I am sure he will worm out of this one, too, without paying a cent.

According to the database on the University of Arkansas at Little Rock website, his license expired on 10/17/2005.  Unless the FCC decides to grant a renewal (unlikely) he should not be on the air now, or at any time in the future.  I guess they'd nail him for unlicensed operation in that case.

1 down, how many more to go?

Not quite that simple, I'm afraid. His application is "pending" which means he can continue to operate. Even if they decline to renew it, all he has to do is file an appeal with the DC Court of Appeals, and unless the judges rule that he cannot operate until his appeal is decided, he can continue to operate.

Well, Glen's batting record of appeals in court isn't doing so well....

I think if he represents himself, he'll lose. Unfortunately, it could take a long time as the wheels of justice are often flat.

[IMG] About time, this action has been dragged way to far. I just hope the FCC gets this matter over and done with, so we no longer have to listen to this bad actor.

Did anyone else get an envelope from Glen Baxter with his two qsl cards and an invitation to 'join' the American Amateur Radio Association for only $35? I did and interestingly enough I can't find him in my logbook.

Great picture of the area he lives in though!! That would make a heck of a retirement place, I suppose.

As one who made not only the Nurd list, but the Nazi list as well
I have to say that I take a bit of satisfaction in this [IMG]

Sorry Glen, but you had every chance in the world to walk the line, instead you walked and walked until you went off the deep end.

Kudos to Riley and the FCC!

His license renewal is still pending. I'll bet he pays the fine and will back on the air.
