Speaking about "FCC TYPE ACCEPTANCE", how do the CHINESE get away with producing VHF or UHF rigs that CAN BE USED TO TRANSMIT on the "FAMILY RADIO SERVICE or GMRS? Especially concerning the FRS which has a DEFINITE QRP POWER OUTPUT LIMIT that "END-USERS" can run !!!
So much for playing by the RULES HUH?

My guess is that the FCC is doing exactly what they're told. Way-way too much money involved to rock the boat.

My dad always told me: Never confuse justice and the law.

    7.200 MHz is not a "channel". It's a frequency.

The FCC has to have concrete evidence of an objective rules violation in order to enforce the rules. Sadly, behaving like an idiot is not an objective rules violation - just listen to "talk radio" on AM BC and you'll see.

Things like failure to ID and exceeding the power limit ARE objective rules violations.

Such as the newer Chinese mobil that transmits on 146, 223, 350, and 440. 350 is an primary an aeronautical navigation band.....Yet they have a stupid mobil transmitting there. Most of the Chinese crap, is open and covers wide portions of the spectrum on each band. Yet they are not only sold here, but very popular.

Likely because the Chinese decide what the Chinese PRODUCE.

That's great! I've never been interfered with by one of these devices! I have experienced malicious interference from "no calls" and idiots on 80, 40 & 20 meter frequencies as well as local repeaters some even dumb enough to give a call!! Literally on a continual bases. Why don't the FCC make themselves useful and stop that?? Oh yeah, not enough money in doing that, is there?! /:

THE FCC IS ALSO AN ILLEGAL/UNCONSTITUTIONAL 'POWER' NOT GRANTED TO GOVERNMENT BY THE CONSTITUTION, EVEN THOUGH RADIO WAS NOT AROUND THEN, IT IS STILL USURPATION OF POWER NOT GRANTED TO GOVERNMENT.
Sad that few know the constitution, and the role a LIMITED government must play.
What I question, is when the FCC was granted authority to levy fines, fees and other 'things' since the hold no legal authority, which is why they can not make l;aws, only issue 'rules', which have no legal power or authority.
A 'rule' is not a law, and can not be enforced legally 'as' a 'law'. Just more bullying by another tyrant of our wonderful government.
As a side note, the drone manufacturers are not a huge problem, but the power of the wallet means far more than any ruling, no matter who makes it.
The FCC needs money, even by theft and deception, but it should die. Government was not created to become our parent, it was created to work for the people, not run our lives, as it is attempting to do.

Would agree as a general rule those powers to regulate by the federal government not authorized in the Constitution are reserved to the States however there is the Commerce Clause in the Constitution which makes sense with respect to those areas where in this instance uniformity is preferable to having the individual states with separate regulations imagine the chaos if we had 50 different sets of regulations of the radio spectrum.

As to the authority of the FCC while there may be individual cases where the Supreme Court has declared one of their actions unconstitutional they have yet to recognize the agency as being unconstitutional and would not look for that to happen any time soon. While as a nation we are over regulated at many levels the complete opposite would no doubt result in anarchy .

BUT!!! There's absolutely NOTHING IN THE CONSTITUTION allowing a GOVERNMENT AGENCY LIKE THE FCC TO IN ESSENCE SELL SOMETHING THAT IS "TRULY IN THE PUBLIC DOMAIN"!!! AKA-"BELONGS TO (ALL OF US)" NOT THE GOV. ENTITY!!!

Is there any evidence for such ?

It's important to use the ham bands to --legally-- experiment . We need much more of this. That doesn't mean that commercial 'unlicensed' use on ham bands should ever be an option.

The problem is that if you don't stop the illegal use, AND DON'T USE THE HAM BANDS for legal experimentation ,you will see an avalanche of requests for commercial waivers for use of those very same bands for things like drones.

There are 20-30 x more drone users than active hams on the VHF/UHF bands. Do the math.

    Use it or lose it.

The government feels its necessary. You could always get a lawyer and file a complaint in Federal court. But you shouldn't be surprised if the lawyer, or the judge, tells you that you are wasting your money.

Well, this is an old and same story here in germany. the chinese companies sell the cheap devices in the hole European union, even the market is regulated by the EU-law. They floot the european market with their cheap and rf-noisy devices. Laser-pointer, Drones, cams and more are free available and the import is not stopped by the governement - a nice new world.

Very happy then went after someone finally. I am in the commercial drone industry and been talking about this crap for years. There are many more to drop the bomb on still but its a start. Now if we can have a drone sold get a drone registered at the checkout would stop some of the nonsense you tubers from screwing up the industry.
