    I think QRZ needs to start a "Wall of Shame" and put these LID stories on them.
    Might make operators respect their license and the airwaves again.

    I wouldn't get too excited about this. The FCC had that Baxter idiot (ex-K1MAN) in Maine dead-to-rights for almost a decade before they finally got him adjudicated and off the air. The FCC long-ago vacated their reputation and responsibilities for enforcement and only get involved if they have their collective arms twisted into doing something. Even then, they are borderline useless. Look at the "W6NUT/R" situation in the LA area and the creepiness of 14313KHz. Over 40 years of the worst kinds of misconduct on the air and the FCC balks over-and-over again. If they'd start showing up on more doorsteps with a US Marshal in tow our bands would be in a lot better shape.

    Gotta remember a few things on Jack Gerritsen's case that differentiates it from Bill's situation.

    #1 He was ex-KG6IRO. The FCC had rescinded his license grant owing to the "oops" rule and any communications that Jack was making were done as unlicensed station. Bill's license is valid - even in a "pending" stage. So for Bill, there was a required process for a licensee whereas there was a very different track for Jack.

    #2 Bill's jamming of ONLY the amateur service took a lengthy process to demonstrate and document. Where Jack screwed up was by 1) jamming a coast guard rescue situation on the Catalina repeater, 2) jamming a DHS emergency preparedness drill, and 3) jamming an ARMY MARS frequency. Frankly, if Jack had stuck to jamming the CARA repeater, 435, and 5.22, he probably could have gotten away with it for a long time. But once he stepped on the toes of the Feds, he was cooked. Indeed, if you look the DOJ press release announcing Jack's arrest, there wasn't a single mention of jamming repeaters during normal repeater operation. Every instance had a public safety or national security consequence. In fact, its rumored that some of the 435 users egged him on to do what he did (jamming the MARS frequency) simply to accelerate the legal process...

    IT'S STILL THE LAW...

    To say nothing is to go along with it and condone it. Spinning the dial is what the "foul language spouters" want. They want to run carriers, music and their mouths and pretend it's not against standing law and get away with it with nothing more than a few moans and complaints and then a smug "spin the dial" retort.

    They imply that a "You don't like it? Then go away. It's war you want? Then you have it. Let the FCC come with their $25,000 fines. Ha...see if we care." trumps all. Right...!

    Yep, they don't care. Retired lawyers will play and pretend they have money to fight it in court and get away with it. But now they are known and not in the shadows, hiding behind mikes and acting like they are bigger than the laws they are breaking. And we can take a hike — just go spin the dial.

    Let 'em pay their fines, let 'em risk loss of equipment, let 'em pretend to be the big guys on the block. I'm waiting for them to try getting rash with some judge and THEN we'll see how big they are. Let them try telling some judge to "spin the dial." It only ends up costing "retired juveniles" time and money and that is one dial I don't want to spin.

    You fellows don't know one half of it. Try listening 3.789 /3.795 every night at about 22:00z and listen to the 3 Italians ruining the dx portion of the band. All the more worrying is that the decent Italian operators don't seem to want to do anything about it.

    How about "Socially Unacceptable Language" for starters?

    If the mush-for-brains types want to act like they live on an island apart from society, then there are plenty in the Caribbean and South Pacific that await them. But I wonder how long they would get away with it in those places.

    Lawyers here want people to think that "getting your day in court" equates to years waiting for the law to act and by this getting away with it and pretending that if it is important, why is it taking so long to get noticed, then when they do go to court, they should see no mercy. Let all those years of going against the law, that pretending that it hasn't been defined in the law, come to bite them in the seat of the pants.

    The majority of hams do what is right and let the law be their guide. When law-abiding hams are bothered by those who are not and point out what the law says, all they have is a "if you don't like my driving, stay off the sidewalk" attitude as if this negates all laws and societal tradition and this apples equally in the Amateur Radio Society.

    We have hams who proudly say that their children, some who are teenagers and even pre-teens, are getting into ham radio but do they allow their children to participate in the kind of activity and use the language heard on 14.313 and 7200??? When showing off Ham Radio to the local school, why is is necessary to make sure the dial is greased in readiness for some animated spinning when some fool thinks communication means using words that have nothing to do with or add to communication? Does barroom talk trump the language we want to hear in schools and churches?

    Ham radio should not be a dumping ground for sgummy lowlifes but if we say nothing to the FCC/ARRL and just "spin the dial," we are turning a blind eye to what hurts the hobby most. Notice too that it is them that must [try] to defend what they do, not traditional amateur society.

    case law is the law plain and simple, when the COURTS tell the FCC they can not do something then the FCC can not do it. what part of that do you not understand, its quite simple. FCC went after someone in 1981 over language, it went to fed court and the court ruled against the FCC, thus making "bad language" rule null.

    did you read N6BHU vs FCC 1981? where the courts ruled FCC can't go after anyone over "bad language"?

    Try this...Would you use it in the presence of your mother, an eight year old, a priest or minister, or in a job interview?

    Other than just being argumentative, does that test pretty well set it out? It works for me.

    U haven't heard OBSCENITY till U tuned into 435!! There's this guy named JACK on there who would make the SALTIEST old sailor blush bright red!!!
    MUSIC??? lotsa music on 435!! The FCC doesn't care!
    435 is IMMUNE to FCC RULES!!

    As an SWL since the 1950s and a licensed Ham since 1977, I've never understood why people use the airwaves to lessen the enjoyment of others. It is the lowest form of selfishness and self-centered depravity, especially when the offender gets some sort of weird enjoyment out of spoiling things for others. Thanks to the Commission for finally acting on this guy, and to quote Gomer Pyle, "Shame on you. Shame, shame, shame!!"
