The seller is misrepresenting the origin of the unit that was actually picked up at a hamfest for resale, and according to some observers, there may be missing parts.

I'm curious how someone might identify the ebay rig this way?

Buy stuff sight unseen and you get whatever you get.
An individual has no liability for misrepresenting stuff.
Good reason to buy goods you have in hand, if accurate description is important.
I sold my mint-condition TX-1 (truly mint, and working perfectly, all original) in 1969 for $150 and thought I got the good end of that deal. http://www.qrz.com/iB_html/non-cgi/emoticons/smile.gif

Really?
From their website:
eBay's Item Not Received or Significantly Not as Described policy requires sellers to deliver items they have sold on eBay and have received payment for. Sellers who fail to deliver items to buyers, or who deliver items which are "significantly not as described", may face possible account restriction and suspension. An item is considered "significantly not as described" if the seller clearly misrepresents the item in a way that directly affects its value or usability. In some cases, eBay will also contact and cooperate with law enforcement to penalize fraudulent sellers.

Another re-seller that mines out the hamfests. I won't buy if I know that's the case as I refuse to encourage the behaviour.

The logo for eBay should be a trio of walnut shells and a scroll bearing the motto CAVEAT EMPTOR.

You definitely should not buy on eBay if you are not sure of what you are looking at.
I have had two sour deals out of more than 100. Not bad in my mind, but caveat emptor does come into play.
Ask questions, and don't delete the "my messages" for the duration if there is any doubt, and insist that all communication be through that channel.
eBay can be a lot of fun, and I have, as noted, participated in a copious fashion, but caution is always the rule..

Well, it looks as if his auction is dead in the water and he's gonna take a nice hit on his eBay listing fees if that thing does not sell. #He's paying 20 bucks to have it listed at the top of the page, and maybe another $60.00 for "Reserve Price Listing" and picture hosting. #And, worse of all, he may die with that thing; will anyone with internet access touch that thing after the questions that have been raised?

He will be lucky to retrieve the $650 that the hamfest seller told me he received from the guy.
You know, it's not so much that he bought it and tried to peddle it on ebay. It is the deceit and misrepresentation, and now the attitude against legitimate questions surrounding his attempted re-sale.
In the time since this has been researched, it appears he's even using an ex-girlfriend's name to register his email account, and that she is unaware of the controversial circumstances now underway.
At least five complaints have been filed through ebay's system of policy disputes.
THIS is where the internet can be very, very useful indeed.

I saw "reserve not met" no less. A $500 profit ain't enough?
I read through some of this character's feedback. Even a few of the positives state problems.

hm. #Reading through the thread on AMfone. #Seller is 217stufforsale. #That sounded familiar for some reason... #Checked my feedback, and sure enough, I did buy something from this guy in November of '04. #Whatever it was, the listing was deleted long ago, but I definitely bought it right around the same time I bought - from another seller - what I described in my feedback to that seller as "a solid mount." #That must have been an antenna mount to replace one that broke [beware the plastic-and-pot-metal guts of the Hustler TLM mount!], so I'm 99% sure that what I bought from 217stufforsale was probably an antenna quick-disconnect.
No complaints with that transaction, but it sure looks I should never consider buying a radio from this dude...

Well, it looks like this guy is going to pull that scam off after all; the "RESERVE NOT MET" tag is gone and he has a bid for 15 hundred bucks!

Now it's $1625.00
To me, the boxes look different as the one on eBay has red lettering on the exterior, and the pacakging of components looks different. However, one could easily unpack and repack and have two different looking items.
To find two separate TX-1's unbuilt does raise questions. Coincidence?

Most do seem to be from overseas shipments though. #Something I wouldn't venture into for obvious headaches. #
So, not sure about this kit. #It could be for real and it could be a scam. #Will wait and see on the feedback.
Sometimes I wonder when the bidders Identities are kept "private" if the real bidder is the seller jacking up the price.

So the Seller gets bad feedback. Comes back with a new Seller ID. I don't see where the negative feedback does much to discourage an individual from selling junk or from others being scammed.
So they get a negative. Think eBay will help you get your money back? I doubt it.

Nobody in the QRZ database by that name. So the guy's not a ham?

Somewhere I read that the ebay account that he's using is registered under his girlfriend's(?) email address.
Guys like this give all of E-Bay a bad name. Come'on now, who doesn't believe that you don't get the best deal on E-Bay?
Actually, I have gotten some very good deals on E-Bay. I just hate to see someone giving what can be a very fun way to pick up stuff a poor reputation. It seems that the venue often gets the rap for the actions of a few unscrupulous individuals!
Too bad, really !

Yeah! Like no one gets ripped off on any of the amateur radio swapsites either...LOL!
WHo knows, but I bet whomever wins that bid and gets it will be posting some feedback one way or the other...
Personally, I can't see buying it for over 400-500$ myself. Even then, there had better be some serious information up front provided.

I've enjoyed great success on ebay. But on this deal, my wife emailed and asked for a photo of the "missing" front panel. None was sent, only insults for asking.
'Nuff said.

Wow.
It looks like "problem solved". http://www.qrz.com/iB_html/non-cgi/emoticons/biggrin.gif
It appears on the high dollar sales he has problems but on the low dollar items, he seems to follow through. A bit of monitoring of this guy may be in order.
One thing I hate about EBay. They say they kick fraudulent sellers off but they just come back with a new ID. So what changes?
One reason I don't use Pay Pal. It too has its fraud issues.

Oh my, you certainly do need to PAY with paypal especially on the high dollar stuff. Buyers are protected out the yang. I've had 2 "signifigantly not as described" purchases refunded thru paypal when the seller wan't to not take them back. In this instance, if you paid with a check or money order, your money would be gone and your only recourse would possible be through court. What an extreme hassel !!! Sure you can leave a negative feedback but it looks like this guy will gladly accept a negative feedback hit to make $1,000 or more.
What ebay needs is a way for anyone to post user comments on an auction DURING the auction.

Yeah, that would be a good option for EBay along with more then just one feedback per Buyer/Seller. Seems the rebuttal is limited.

The doof made the bidder's list private so no one like us good guys could contact them and give warning.

good for you! did you have to buy paypal insurance [prior to paying] to get the refund?

Hi wd0oct, I'm not familiar with this insurance you mention. The "signifigantly not as described" section is a standard paypal feature whereby a buyer can lodge a complaint. No cost involved.
Also, pay through paypal onto a credit card and NOT a direct payment out of your checking account. If paypal should rule against you, there are other instances where you can return the item to the seller (use a tracked shipping method for proof of return) and then you can do a charge-back through your credit card company to get your money back.
Best bet when buying is only buy from very open-seeming sellers (folks who don't hide their feedback ect....) and have very high positive ratings. The item you may want is not the only one in the world and another one will come around. Be patient. So don't press yourself by taking a chance with a shady looking character like this guy.

I just noticed this...
When there's something on the order of "L@@K" in the title, it screams, "PUNK!!!!!!!". I pass on anything that's intentionally garbled like that.
This punk did it. So I wouldn't have bid anyhow.

{grrrrrrr} Yeah... #I HATE THAT! #What the fleep does that spell, anyway?
As I type this, I'm checking eBay. #Currently, 65.024 ITEMS, not counting stores, have "L@@K" in their descriptions. #5,534 listings [not counting stores] contain "LQQK" - more pointless garbage.
11 items - 8 of which are from eBay stores - have both.
Edit: Helpful eBay tip: Append -(L@@K,LQQK) to all searches. http://www.qrz.com/iB_html/non-cgi/emoticons/biggrin.gif

Interesting about all the Sellers unidentified which means it could be the Seller bidding on it.
