From the Drudge Report (http://news.yahoo.com/news?tmpl=story&u=/ap/20041012/ap_on_go_su_co/scotus_tuna_lawsuit_1) comes a story of some nine year old kid cutting her finger on the edge of an opened can of tuna fish.
The little twit and her family want to sue the manufacturer for damages and pain and suffering in excess of $75,000. WTF is the Supreme Court fooling around with a rediculous case - which on its face is an insult to common sense - that's got ambulance chaser written all over it.
AAAAAAAARRRRGHHH!!! THESE PARENTS SHOULD BE LOCKED AWAY FOR CHILD NEGLECT!
I'm pissed WAAAAAAAAAAAAAAY off!

In my house, we don't call that a lawsuit, we call it a learning experience. Sort of like when I was a kid, and pudding came in those little tin cans with the pull top. They told me and told me not to lick the pudding off that lid. Did I listen? No. Did I sue anyone when I cut my tongue? No. Did I learn not to lick that darn lid? No. I did learn to be more careful when I licked it the next time though.

It used to be if you stubbed your toe on a sidewalk you thought "dumb me, next time I'll watch where I am going".
Now days a lawsuit is immediately started against at least the following:
The owner of the building in front of which the "accident" happened.
The owner of the business closest to the location of the "accident".
The contractor that installed the sidewalk.
The architect that designed the building and the sidewalk.
The surveyor that surveyed the site.
The ready-mix firm that supplied the concrete.
The manufacturer of the cement that was used in making the concrete.
The quarry that supplied the limestone that was used to make the cement.
The quarry that supplied the sand used in the concrete.
The quarry that supplied the gravel used in the concrete.
The owners of the trucks that hauled the sand and gravel.
The entity that supplied the water that was used to mix the concrete.
The inspector that inspected the sidewalk while it was under construction.
And anyone else that the lawyers can think of!
I believe that there are more attornies in the United States than in all of the rest of the world combined. Many of them live just for these "personal injury" type of cases. It is no wonder that doctors and other professionals are leaving their professions since there are so many frivilous lawsuits, so many unreasonably high awards, etc.

Anyway, to get back on topic... I am hoping that the Supreme Court is taking the case in order to slap it down and take away the outrageous award... but I could be wrong.

The whole thing sounds like a shoo in for a Stella Award. For those of you who don't know about the Stella Awards. They are given each year for the most frivilous lawsuit with a large award. They are named after the old woman who sued McD's for a gazillion dollars when she burned herself on their hot coffee when she ripped the lid off while holding the cup between her legs.
You really have to wonder when things like this happen and nobody stops them.

What ever happened to personal responsibility? The way it is today is that I have a RIGHT to do anything and a responsibility for nothing. If I make a mistake(cut finger, stubbed toe, etc.) it is someone else's fault.

In multiple surveys, they most hated word my Americans is "No". I would have thought it would be "war", or "hate".
But we all think we know better and are indestructable. My oldest son had been warned 50 times about putting things in his mouth, but it never registered on his brain until he swallowed a small plastic chip and had to have his stomach pumped.
The retelling of the story for a short time included the obvious lesson of stupidity. He told me soon enough he did not like to look stupid. I told him that he'd lose the label when he lost the habits. He did.
People sue to escape personal blame. I have done some dumb-assed things in my life, but the ownership of them is mine. My bad.

This family should be an immediate shew-in for a Darwin Award with logic to sue like that.
I cut my finger on a Folgers coffee can. Cut it deep. (this is true)
Should I spin the wheel and file a lawsuit because my can opener left a ragged edge on the can? Should I file against Folgers, or the maker of the can opener, or the company which produced the metal for the can?
Maybe the grocery where it was purchased, or make the case that the can was slightly damaged in transport from the warehouse which might have caused the sharp edge when it was opened?

Once upon a time a fellow I know intimately well, and who is married to my wife, was cutting some 2X4's. But instead of using a circular saw, he was using a portable jig saw. Something about right tool, wrong job. Or was it the other way around?
After cutting through a couple of them, he noticed the wood burning at the cut, from the heat of the saw blade. But then, a few cuts later, he didn't see that.
Curious, wondering why the blade was no longer hot, he stopped the saw (good thinking, Ed) and he carefully testing the saw blade temperature by pinching it between his thumb and forefinger.
Indeed there was smoke. And a blue cloud as well. Removing those fingers from the saw blade, which showed no ill effects, and certainly did not light up a sign saying "I'm hot," he went immediately to the sink and soaked his fingers in cold water.
Years later, when he was able to write again, he began to make a list of all the folks he could sue.
1. Saw manufacturer. Certainly there should be a warning - in fact, two warnings. (a) do not touch hot blade. (b) do not touch moving blade (Been there, done that, too, a story for another time.)
2. Electric company. If they had not supplied power, the saw blade would have moved much more slowly, and been quite a bit cooler.
3. Timber company. If they had precut the wood when they harvested it, this entire incident could have been prevented.
4. Trucking company that delivered the timber. Yes, certainly they knew some idiot was going to burn his fingers while cutting it, and they should have advised him of the dangers.
5. Anyone else in the wood cutting, transporting, retailing, trimming, painting, business, who was convenient and had some money.
While I write this as satire, directed at my own dumb self, (a true story) the serious truth is, we DO try to sue everyone. We want to sue gun manufacturers because someone shot someone. We sue everyone in sight if there is a plane crash. We put labels on things -- "DON'T DO THIS" (like on SUVs - don't do S-turns) and then the idiot that does them and gets hurt sues. The warnings are already there, yet it is grounds for a lawsuit if you ignore or disobey the warnings. It must cost us billions of dollars a year in price increases on everything, every product we make or import, as well as every job done (malpractice insurance, for example.) I got so paranoid over this I actually had people I knew who I would not invite to my house, as I felt they were a liability, would harm themselves on my property and sue me.
I don't know what the solution is, or even if there is one. But we are suing ourselves out of existence.

By the way, I once licked a knife after cutting a birthday cake that had been given to me while I was at work. I was in radio (DJ) and made that remark on the air, that I had cut my tongue. And that I had got a call from my wife asking for a divorce. I also (really) got a call from my boss reminding me we were in Bible Belt.
Wonder I didn't get sued.

The Supreme Court does not just reach out and glom onto these cases. It *accepts* cases the Court believes need to be decided to (among other things) establish reasonable precedents, or those for which, among the District Courts of Appeal, no consensus exists and precedent is therefore different in each District. # It also may well be that the Supreme Court is involved here because the Justices want to reign in the practice of assessing another liable for one's own foolishness.
