You're the one who categorized them "all" as war criminals. But operating in Gitmo pretty much makes one an accessory to war crimes. However, at Nuremberg the courts (IMT) & NMT went after the big cheeses and left the small fry to their own justice systems. I'm sure there are valid chain of command defenses that could be used for Gitmo.
I'd have to reread Geneva but I probably was a war criminal during the sixties and so probably were a lot of my friends. But, it never occurred to any of us to torture a prisoner. Later, I came to my senses and became an anti war hippie. That war, like Iraq was also based on a phony casus belli.
You sound like the kind of guy we would have fragged ;-) Kinda, like Judge Roy Moore..., who was Captain Roy Moore at the time and was "dry fragged", three times by his own men.

Hmmmmmm, one thing for sure, Moore lead a band of idiots or cowards, possibly both! Never heard of any officer getting 3 "dry frags". One "dry" is standard, second one and he's dead. ;):cool:
