On March 21st Mathew Mosk of The Washington Post, reported that Sen. John McCain has officially broken the $54 million dollar spending limitation imposed by the presidential public financing system.

Obama is not limited by law on how much he can spend because he is spending his own money and not the taxpayers.
He did not apply for nor did he accept public funding.
McCain broke the law because he applied for public funds, accepted the terms and the violated them.

Thank you for the compliment on the density of the grey matter between my ears, it indeed functions well and at a high level. The availability of a higher number of functioning brain cells gives me somewhat of an advantage in the competitive world we live in today.
Another Great Depression is indeed an ever present economical possibility and this is why I keep the appropriate amount of funds necessary invested in companies that paid a dividend all through the first Great Depression, low yield but rock solid performance.
I'm sure that you do the same? :cool:

The first is true. The second McCain thought to be true and isn't. The third is irrelevant to the point in question.
McCaid did, indeed, file for public funding, at which point he became responsible to obey the rules.
He filed to withdraw, but his request has never been granted, and so, he has not withdrawn.
Further, he pledged public funds as a backing for his earlier loan. At that point he no longer had the option to withdraw. Since the pledge came before the filing to withdraw, had the commission ever met to consider the petition to withdraw, it should have denied it.
He has since raised more money than he is allowed to.
It is the filing for federal funds that put the limit on his fund raising. It matters not how much federal funding he has received.
But, as you say, this is no more than an intellectual exercise. The Commission could not have met, as they have not a quorum, and that alone will be seen as reason enough to accept the intent for the deed. McCain will be forgiven for having "forgotten" that he could no longer withdraw from federal funding, since he has already repaid the loan.

A candidate is allowed to qualify for government funding of their campaign during the primaries.
