The link describes a love triangle situation whereby an 18 year old was having an affair with the accused, and admitted killers, wife.
He was shot outside the home of the couple.
I feel excessive force was used but in the sense that a mans home and property are his castle and the slain was...well aquainted with the guys wife very well, I can see how he got a little irate and pissed off.
I would have a difficult time giving him a tough sentence since I can see myself reacting in a less than logical fashion if faced with the same situation.
What would you do as a juror? Granted you do not have all of the evidence?

My initial gut reaction is McLean shouldn't have stopped with his wife's teenage lover. If I were a juror, I'd push for some time in jail (less than a year) and a few years on probation.

This again is my initial feelings with only reading a couple of paragraphs on a webpage.

I myself would give him the maximum for pre-meditated murder. He shot an 18 year old kid in the kids car parked in the street. The killer said he said he knew they were having an affair. I blame the adult teacher wife more than the kid. I don't see any excuse for this murderer at all.

The slain young man was not on the killer's property. He was not making any threatening moves.

It is irrelevant if he was carrying on with the killer's wife. A wife is not property but an independent person. You do NOT own your wife. So an affair is no justification for murder.

The killer should have the book thrown at him. He had other options. He could have divorced his wife or sued the young man for "alienation of affections" or both.

I like how the prosecutor is trying to make sure he goes broke defending himself. Now that's justice.

In my opinion, the dude shot the wrong person from the affair.

I agree, but 18= adult.

He may have been young, but they are all adults.

I think the circumstances should be taken into account in sentancing but it's open and shut murder.

I can understand the anger, but he didn't need to kill anyone.

There is NO excuse for this guy

It is irrelevent that the slain young man was 18 and therefore an adult.

It is irrelevent that his wife was unfaithful.

He had absolutely no right to take the life of another in this instance.

In this country (and in most others), legal justice is a commodity that must be purchased for a monetary price.

In many situations, you can be totally innocent of bogus charges and know it, but still have to exhaust your financial assets to defend yourself through the legal system.

In the case at hand, I think the guy is guilty of murder.

The trial has been delayed until probably neat year but the charge is second degree murder with a max sentence of 25 years.
I am guessing the charge will be reduced and he will get less than 5 at most.
