View Full Version : Court Ruling on FCC Indecency rules

The Federal Second Circuit Court of Appeals has overturned the decency rules that banned certain words from the public airways.
While the ruling MAY make it legal to "drop the F-bomb" on ham frequencies, I trust that none of US will want to do it. Just because you CAN do something on the bands doesn't make it right! SEE:

I haven't read the opinion yet, but it may be that the ruling only applies to fleeting, unintentional use of dirty words.

As I understand it, it only applies to incidental usage during live broadcasts. Deliberate, planned usage is still verboten, and once detected, must still be blanked during rebroadcasts.
And, since hams don't broadcast, Part 97 is unaffected.

Well, in a way that's a shame. If people want to talk like that within their own cliques, where in will not/cannot be heard by the general public, that's one thing. But this freedom of 'artistic' expression and freedom of speech where others are forced to listen to it (if they want to continue with whatever their normal activities are) is pretty sad.
The old 'turn the dial' thing is not the answer, because #we really should not have to stumble across it while tuning through the bands. Just my opinion I guess. Hopefully, it will not get to that point.

George Carlin, had a bit about The 7 Dirty Words You Can't Say On Television. #Unfortunately, most have become blaise now on commercial and cable tv. #Howard Stern, Don Imus, and other Shock Jocks got away with a lot of 'verbage' that is not used in polite company, anyway.
When I was a radio announcer-engineer (aka. disc jocky) in the mid-60's, a shoot or gol-lee was grounds for termination. #Back in the late 50's and 60's you NEVER heard a curse word on any ham band. #Now, 75 & 40 are poliferated with old,coggers with old callsigns cursing, making racial statements and demeaning ladies. #If you ID and ask they refrain from using such language as your child, grandchild, or wife is in the room with you, you get "blasted" with MORE unsavory language. #Taping it and reporting it to Mr. Hollingsworth does no good. #The F.C.C. is dead as far as language use is. #Not all of the bad language you hear on the ham bands can be attibuted to "CB'er's" or No-Coders. #It's just that we, who care, have not taken the Powers that Be to task for allowing such behavior on radio, tv, and even the movies.

Don, I DID send a recording to Mr. Hollingsworth, after first contacting him as to the complaint. Seems like things quieted down for awhile & in checking the particular 75m freq, they were still there, but mindful of proper talk & speech. The worst was on Friday nights when they got likkered up. And, yes, when I mentioned something to them, I was their target for a l-o-n-g time...filled up a 90 minute cassette, and more....
I haven't been to that particular freq lately (haven't been operating 75m AM) but the last time I checked, everything was much, much better.

I am not surprised. Out televisions, movies, etc. constantly bombard us with this stuff and why is radio any different? our society allows it, says far little about it, so why not?

Proliferated? Come on Don that's like saying every op on the band is a trashmouth, I don't think so.
Sorry to hear you ran across some old drunk potty mouthed individuals while your wife, kids, Grandmother were in the room and forgot to tune off freq, or change bands. Instead you jumped them and Grandma got an even bigger earful of crap.
In retrospect don't you think it would have been easier to just spin the dial and let it go?

Of course it would have been easier, but ya know what? That's exactly what most of us have been doing for years now - spinning the VFO and moving on. That's why the problem has gotten to where it is; WE allowed it to do so.
Easier? Yes. Smarter? Depending on how you see it, maybe. The right thing to do? Absolutely not, and the conditions found on OUR bands are proof of that.
Look, I worked in a state prison for 24 years. I have the mouth of a longshoreman. But you will NEVER hear that on the air. I believe that stuff is wrong on the air and I'm able to control myself. These other lids can too - if we force their hands.

The only reason some want you to just move on and let those OTs act that way is so that they can later blame it on the newbies and/or no-coders. I have been saying all along it is NOT the newbies doing that stuff. They may not know all the proper terms and lingo, but they are NOT talking like common CBers - like the coded Extras from years ago are doing. I agree - it is not right and SHOULD Be stopped.

The lower the iq of the speaking person, the more vulgarity you get to hear .
There are too many nice / normal words available to have to resort to using vulgarity in a normal conversation.
I seriously doubt if GOD would want any one who cusses to be running around up in heaven.
Most folks who cuss are just desperate for attention ....some what to the effect that very few people can argue and whisper at the same time.

I'm 64, a 30 year Army vet and I don't use vulgar language in front of ladies. One young 18 year old at work where I get 'mad money' 3 or 4 times a week, used the f-word as if it was the ultimate adjective. After about a week I mentioned to him that it was just making him look dumb around the girls. I had to compliment him the next week and now it's been a year. Of course some times there is a slip but he has told me many friends of his have mentioned how much better his conversation is now.
You got to tell them or they won't know it.

We don't rise up in collective indignation as special interest groups tell us that, indeed DEMAND, that men should "marry" men and "gay" couples should be adopting children.
Blindness is a key part of a society's demise; IOW, the things that would have shocked us 20 years ago, now are being accepted with hardly a sigh (.............what can I do, I'm just one fellow), then idly flip thru the channels to stop and catch the naked lady on an XX channel. #We now stand for and accept such shows as "Queer Eye for the Straight Guy" where a few years ago, it would have been soundly denounced. #The &%$#*
F**** that would've caused outrage on TV now waits in the wings to be accepted fully. Just a step at a time.....anything will go. #The things that guided us now will be (and are quickly being) discarded. #
It's just a symptom of a SICK, dying society. And when your cows got out, your neighbors would come help you get them up AND mend the fence. We drove schoolbusses at age 16-----did you read that right?.................Yes! #We DROVE schoolbusses as soon as we got our licenses ( took my bus test in the 10th grade 2 months after getting my license!!) If you think that was crazy, it was the state of North Carolina and it had, at one time, the BEST schoolbus accident record in the nation! #My bus (I didn't get a regular route, but was a sub) was a '56 GMC snubnose, 90 passenger. #Why did that work? #Because we were FARM kids who learned responsibility #at an early age; we were slopping hogs and feeding chickens at 8 years old!
